Nature of Use

The services of Copac are intended for personal use only. No user shall use Copac for commercial purposes. Any unauthorised use of Copac, including use of any sort of member information for commercial use, unauthorised tracking of member usage patterns, use of email addresses of members to send unsolicited communication or unauthorised linkage to Copac is strictly restricted.

Copac’s intellectual property such as strategic and creative concepts, videos, photographs, audio clips and written content is protected by applicable Indian and international intellectual property laws and any use of the same in any manner, either directly or indirectly, either in whole or part shall result in infringement of Copac’s intellectual property. 

All content on Copac Media, such as text, graphics, logos, button icons, images, audio clips, video clips, digital downloads, data compilations, and software, is the property of Copac Media or its content suppliers and clients and protected by Indian and international copyright laws. The compilation of all content on this site is the exclusive property of Copac and protected by Indian and international copyright laws. All software used on this site is the property of Copac or its software suppliers and protected by Indian and international copyright laws.

‘Copac’, ‘Copac Media’, the Copac Media logo and other marks indicated on the site are copyrights and trademarks of Copac. Other Copac graphics, logos, page headers, button icons, scripts and service names are trademarks or trade dress of Copac Media. Copac’s copyrights, trademarks and trade dress may not be used in connection with any product or service that is not Copac, in any manner that is likely to cause confusion or deception of users, or in any manner that disparages or discredits Copac. Limitation of Liability

You understand and agree that you use the site and services at your own discretion and risk and that you will be solely responsible for any damages that arise from such use.

 

Under no circumstances shall Copac be liable for any direct, indirect, special, incidental, consequential or punitive damages of any kind, or any other damages whatsoever, including without limitation, damages related to use, misuse, reliance on, inability to use and interruption, suspension or termination of the site or services, damages incurred through any links provided on the site and the non-performance thereof and damages related to use, sales, data, goodwill or profits, whether or not Copac has been advised of such possibility.  Your only right with respect to any dissatisfaction with this site or services or with Copac shall be to terminate use of this site and services.

 

 

Dispute Resolution and Governing Law

In the event of any dispute or difference arising  between  the  Parties  hereto  in  regard to any  matter  relating to or connected  with  this  Agreement,  the  same shall be referred to Arbitration by a sole arbitrator who is appointed by Copac, in accordance with the Arbitration and Conciliation Act, 1996 and the Arbitration & Conciliation Centre Rules, 2012. The venue of arbitration shall be the Arbitration & Conciliation Centre - Bengaluru (Domestic & International), at Bengaluru. The decision of the Arbitrator shall be final and binding on both the Parties. The venue for Arbitration shall be Bengaluru and the Courts at Bengaluru shall have exclusive jurisdiction in regard to this Agreement where permissible under the Arbitration & Conciliation Act, 1996.

Binding Nature

This Agreement shall constitute the entire Agreement between the Parties hereto and shall be binding on the parties.

 

You have read this agreement and hereby agree to all of the Provisions contained hereinabove.
